The Analysis Of Legal Mechanism Of The Currency Swap Between China And Other Countries Along "One Belt One Road"

Since the proposal of "one belt one road",our country has been signing more and more bilateral currency swap agreements with countries along side the belt and road,which will play one of tools to stabilize the countries finance and boost regional economic development.However,since countries develop differently in economic and varies in the regulation of the internal finance,with the increase of currency swap arrangements,it becomes more and more meaningful for researching the legal issues contained in this area.This essay aims to strengthen internal research from a new perspective.This article mainly includes four parts.And in the first part I will put my attention on the fundamental questions about the currency swap.And then,from the principal of international law,economic and the actual requirement perspective,I will discuss the feasibility of the currency swap as well as the reason why such swap arrangement develops so faster.In the end,I think the sovereignty of currency endowed to every country the power to make the agreement,and the principal of international law,economic and the actual requirement make the swap reasonable.In the future,the currency swap will continue playing an important role.In the second part I will discuss the agreement of the currency swap.Firstly,I will introduce the fundamental principle,and assuming that when our country makes currency swap with other countries we should adhere some overall requirements.And then,I will analyze the current conditions about the currency swap between our country and other countries based on their unique geography characters.In the third part,I will analyze the defects of the legal mechanism of the currency swap and give my suggestions on problems and risks existed based on the agreement.In the fourth part,I will give some profound suggestions in order to make full use of currency swap,and further contribute to the establishment of net of international currency swap based on Renminbi.In the end,I will give some conclusions that the currency swap will hardly exert its function if seldom country apply to set up the money under the agreement.
