With the continuous development of computer technology,online games,as an emerging industry is occupying an increasingly important position in the national economy.Because the online game industry is not mature enough,so there are many problems in its develop process,such as plagiarism,plug-in and so on.The reason of these problems,fundamentally,is the domestic legal protection of online games has not yet formed a unified and effective system,intellectual property legislation and judicial practices are not clear to that which copyright object the online game belongs to,it makes the online game still can not be effectively protected in our country.Judging from the judicial practices,Chinese copyright protection of online games is tending to break down each elements to determining whether they infringe copyright,this approach not only damages the integrity of the online game,but also can not promoting the protection of online game copyright.Therefore,based on the status of copyright protection of online games,this paper will use the case analysis,theoretical analysis and comparative research methods to explore the online game copyright protection mode.This paper will be divided into four parts:The first part is a brief introduce of the case.This paper chooses the first case of online game copyright infringement cases which protects the online game as the film-like works,introduces the basic situation of the case,and discusses the controversy focus of the plaintiff and defendant in the case.The second part is a detailed analysis of the focus of controversy.In this part,this paper will elaborate the definition and classification of online games first,and then from the theoretical study of online games in the copyright law can constitute what kind of workwhat kind of works can online games play in the copyright law,and then introduces the different cases of online game copyright infringement,compares and analyzes the advantages and disadvantages in different cases,and finally will researches on the way of copyright protection of online games abroad,to explores the applicable experience in our country.In the third part,based on the research above,this paper will explore the nature and scope of copyright protection of online games,analyze the process of judging the copyright infringement of online games in practice,build the copyright protection mode of online games in our country,and review the selected cases at the beginning of this paper.The fourth part is the summary of the full text of the argument and prospects for the future.
