Research On Legal Issues Of The Supervision System Of The Circulation Of The Right To Contracted Management Of Rural Land

With the rural labors transferring from first industry to second or third industries,the phenomenon of rural land being unused arose constantly throughout the country,which led to spontaneous and random farming replacement and the initial circulation of the right to contracted management of rural land.The prospering second and third industries and better economic circumstance and job opportunities attracted farmers leaving the rural land they depend on for survival.In order not to let the land get idled,part of them circulated the land to get extra incomes.Recently,the speed of circulation of the right to contracted management of rural land grows never before,the scale and the number of regions concerned appears a tendency of increasing.The circulation of the right to contracted management of rural land can not only optimize allocation of rural land resources,but also can speed up the procedure of urbanization.Rural land has two attribution,including grain production and social order stability,which makes the circulation of the right to contracted management of rural land concerns the production and security of the grain,and the maintenance of social order in rural areas,which has a bearing on the survival and development of countrymen,thus,the government pays great attention to the supervision on the circulation of the right to contracted management of rural land.According to related laws and regulations,major supervision obligation which concerns aspects of regulating the behaviors actors,procedure and the actual using of the rural land after circulation is undertaken by administrative department in charge of land and agriculture.The key point of supervision is to implement the system of strict control on the usage of land,in order to protect scarce cultivated land resources.However,due to the improper-designed rural land property right system in our country,formalized system of registering the right to the contracted management of rural land and low legal literacy of officers in the supervision department,the failure to supervision the contract of circulation of the right to contracted management of rural land and protect the cultivated land need to be resolved urgently by the supervision department.This paper adopts documentary analysis and empirical analysis to research on the issues aroused in supervising the circulation of the right to contracted management of rural land,analyze the cause of the issues,and promote some suggestions to refine the supervision system.Apart from the introduction,this paper includes the following aspects:The first part is about the overview of the supervision system of the circulation of the right to contracted management of rural land in our country.Beginning with the concept of the supervision system of the circulation of the right to contracted management of rural land,then introducing the system from three aspects,they are regulatory bodies,supervising content and tangible system,and ending by introducing the historical development of the supervision system in the end.The second part mainly tells the current situation and deficiency of the supervision system in operating.The third and the forth part mainly analyze the cause of the deficiency of the supervision system,then promote suggestions to overcome the deficiency from five aspects.They are perfecting the rural land property right system,strengthening the system of registering the right to contracted management of rural land,regulating the system of circulation contract,constructing training system for officers in the supervision department,and reinforcing the usage supervision of the rural land after circulating.
