A Study On The Disciplinary System Of Lawyers In Nanning City

In our country,the lawyer team is an indispensable important rule of law power under the leadership of the party building a socialist country ruled by law.In the context of comprehensively promoting the rule of law,the central government attaches more importance to the management and construction of the lawyer industry.The Fourth Plenary Session of the Eighth Central Committee of the Party made it clear that the lawyers should strictly abide by the professional ethics and professional conduct,strengthen the access,exit management,and strictly implement the disciplinary system of illegal and illegal practice.Therefore,it is very important to study and improve the management of lawyers and their supporting disciplines in the new situation.Lawyer discipline is an indispensable part of the lawyer's management system.Although discipline is not the purpose of management,the realization of management objectives requires a sound disciplinary system to maintain.There is no disciplinary means,there is no deterrent management,it is difficult to achieve the purpose of management.Based on the review of the development process of lawyers' disciplinary system in our country,this paper analyzes and studies the current lawyer disciplinary system in China,on the basis of studying,analyzing and comparing the disciplines such as Britain,the United States and France and the lawyers in Taiwan,There are some problems in the disciplinary system of lawyers,such as the opaque nature of the disciplinary procedures,the poor operation of the 'disciplinary institutions,the lack of disciplinary procedures,the ineffective role of disciplinary services,the ineffective use of disciplinary practice,the imperfectness of remedial rights and so on.In view of how to establish and perfect the lawyer disciplinary system which suits our country's basic national conditions,the author thinks that it is impossible to fully copy the western model from the reality of our country and not to emphasize the high degree of autonomy of the lawyer profession.We should combine the basic national conditions of our country,give full play to the advantages of the system,strengthen the party building work of the lawyers industry,and coordinate the overall progress of the parties.Adhere to the judicial administrative organs of the disciplinary discipline of the dominant position,play the role of administrative punishment in the disciplinary role of lawyers.The lawyer bad practice information disclosure and inquiry mechanism and the national credit system simultaneously construction,synchronization management,effective convergence,establish a lawyer practice exit mechanism.
