On The Agent System Of The Defendant In Administrative Litigation

There are many different types of performance in the administrative litigation agency system,and the external lawyer agent is one of the forms.Over the past few decades,the legal system of our country has gradually developed and matured.It is undeniable that the form of the appointment of an external lawyer as an agent of an administrative litigation has helped the effective construction of the government and the administrative litigation.However,with the change of the new era,the level of the rule of law in our country has been progressing continuously,the mode of government service has changed,and the way of working thinking has been changed.The form of the external lawyer as the agent of the administrative litigation has revealed that the malpractice is more favorable than the benefit.This paper discusses the advantages and disadvantages of the system through two aspects of practice and theory,so as to make a new interpretation of the agency system of the administrative litigation under the existing system.In this paper,according to the existing problems arising from the empirical,then the problem back to the theoretical discussion,and then give conclusions and recommendations.The first chapter leads to the central problem by analyzing the empirical case data and the current legal norms.The second chapter examines the question of the defendant's agent in the administrative litigation through the lawyer's perspective.The third chapter expounds the theoretical support of the central argument from the academic theory.The last chapter gives the final recommendations for the current system.
