Research On The Regulation Of International Law In Cyber Warfare

The traditional methods of warfare are gradually breaking the contemporary information fighting method,method of combat cyber warfare model to people can not imagine the way,also because people to combat this new understanding is not deep enough,and it will bring harm is very great.In recent years several major network security incidents show the network warfare as new combat means and methods to the whole world,brought great security risks to the country.It has produced great influences in the development trend of network warfare in many fields of international law,the international law has no legislation specifically for network warfare,many international regulations are not suitableFor cyber warfare.Although it is different from the traditional way of war,but since it also belongs to the category of war in nature,it should also be affected by international law jurisdiction and constraints.The purpose of this paper is to discuss the international law problem of network warfare,mainly from the two aspects of the law of war and international humanitarian law the research and analysis,specifically from bellum to analysis for network attack is a force and the distinguishing principle of international humanitarian law and the principle of neutrality for network warfare,which is conducive to safeguarding the safety of the international community.This paper is divided into four chapters,mainly discuss the issue of how to apply the rules of international law in the outbreak of war network.The first chapter is the practical study of cyber war,mainly on the network sovereignty establishment and network warfare history do a brief introduction,which leads to some rules of international law in the face of network war implementation difficulties and legislative norms of network warfare reality.Second,the three chapter is the main part of this paper,from two aspects of right of war and the international humanitarian law analysis of the existing rules of international law applicable in wartime in the network encountered difficulties,and put forward the corresponding legislative proposals.The fourth chapter introduces the Countermeasures in China network war andThinking,take the initiative to comply with international regulations,the initiative to defend national security,and actively participate in international legislation.At last this paper gives a brief summary,and show to the international community as soon as possible to develop specific rules of international law of cyber warfare.
