Research On The Implementation Dilemma Of China's Personal Safety Protection Order And It's Dilemma Solution

Since China's "anti domestic violence law"was enacted on March 1,2016,the scope of personal safety protection order has extended significantly.And most of the respondent does not appear to violate.It is obvious that it has an asylum effect on the victims of domestic violence,with initially apparent positive effect of the introduction of the system.However,in judicial practice,there are still many challenges and difficulties in the implementation of the system.The reason is that the court,as the executive agent,is not able to bear the tough task and relevant laws and regulations do not have clear and specific operability.This paper puts forward to the corresponding solution mechanism for these difficulties and causes:through multi institutional co-operation,the injunction can be executed by public security agencies,with the communities' assistance to supervise the implementation;the rules endeavor to improve the operability of contact prohibited contents and the legal consequence sin violation of a protection order.
