Research On The Legal Aid System In Colleges And Universitie From The Perspective Of Fairness

The system of legal aid in colleges and universities is the product of the development of the country's rule of law civilization.It is an important component of the reform of higher education development.It is an effective complement to the government legal aid system.It is propitious to promote the management of the school according to law,reform the law education,highlight human rights values and achieve precise assistance.Since 1992 Wuhan University established the social protection center of the rights of the weak,relying on universities,colleges and universities jointly established student legal aid agencies have sprung up.The promulgation and implementation of the Opinions of the Ministry of Justice on Further Strengthening the Legal Aid Work in2001,and the promulgation of the Legal Aid Regulations in 2003,the State has made explicit support and encouragement to provide a clear legal basis for institutions of the university legal aid.However,up to now,the state has not formulated a unified system of university legal aid to guide colleges and universities to carry out specific work,colleges and universities are still keep the status of self-exploration and mutual learning stage,the exploration and research for legal aid institutions to carry out legal aid special System,but a handful.In this paper,based on the university campus,using the research methods of literature analysis,practice research,case analysis and comparative study,tracing back to the legal aid system at home and abroad from the start,and then analysis the university legal aid system of legislation and implementation,and by clarifying the the scope of the legal aid system in colleges and universities,explaining the relevant concepts of the legal aid system in universities and the subject relationships involved and combing its internal legal theory and the typical university legal aid mode,to provides the premise for the construction of legal aid system in colleges and universities.Then,based on the fairness,human rights,democracy,security and order of the legal system itself,the implicit and explicit values of the legal aid system in colleges and universities are stratified and analyzed to show the value and significance of this study.On this basis,the construction of legal aid system of colleges and universities carried out from three aspects,such as institutional staff,standard setting and concrete implementation,on the principle of "weak care,efficiency,coordination,comprehensivesupervision",put forward the concrete solutions such as the legal aid operation mode of "unified acceptance,grading review,assign a combination of powers and responsibilities," the implementation of legal aid projects and legal aid services conversion system,through the use of new media technology to undertake processing and filing to sort out the facts of the case,highlight the results of assistance.And in the connection with the general legal aid,to construct the school legal aid system with the characteristics.
