The Legislative Defect And Perfection Of The Crime Of Rape In China

Rape is a kind of traditional crime,the punishment is very severe.Every country has rules on the crime.Because the traditional concept of social thought,women is so weak in the society,all countries give more protection about the rights and interests of women,rape is not exceptional also.But in practice,there have been some new phenomenon of sexual,it makes us realize that our country's present criminal law on rape is hysteresis and conservative,the existing provisions of rape can't fully and equally protect the citizens' rights and interests.New abuses are constantly emerging,there are new characteristics,which makes us realize that the improvement of the rape is necessary.This article tries to analyze the legislative defects of our current criminal law on rape,learn the draw lessons from foreign legislative experience of rape.And combined with Chinese actual conditions,I hope to do something focus on rape crime subject,object,way of sex,homosexual rape,incest,rape,rape,diseases and punishment and so on,which may be some proposals to perfect for the legislation of rape in China.
