As an old form of credit,private lending for a long period of time to retain fresh vitality.In recent years,with the deepening development of China's socialist market economy,the contradiction between supply and demand of funds has become increasingly prominent,a single formal financial lending has been unable to meet the needs of the lending market.Against this backdrop,private lending has become increasingly prosperous,especially in the vast rural areas.In general,as a form of non-traditional borrowing,rural financial lending has largely compensated the inherent shortcomings of rural financial institutions in China due to the lack of formal financial organizations and the form of financial lending,which has promoted the flow of rural funds,A considerable number of farmers and peasant enterprises survival and production of China's rural economy has played a significant role in promoting.However,the spontaneity,blindness and asymmetry of rural financial lending have led to the information asymmetry in the rural financial lending market.This phenomenon further aggravates the rural financial lending market itself such as high interest rate,Effective supervision and other issues,making the rural financial market tends to chaos,the overall development of the financial industry has also had a negative impact.Based on the reality of China's rural financial lending and the theory of information asymmetry in the field of economics,this paper aims to explore the legal regulation system in line with China's national conditions in order to deal with the information asymmetry of rural financial lending.In general,this paper consists of two main lines,three modules,five chapters.First of all,in the first chapter,the background and purpose of this paper are clarified,and the research methods used in this paper are briefly introduced,and the research status of scholars in China and abroad is briefly reviewed.The second chapter is the basic theory part,elaborates and analyzes the information asymmetry theory and the rural financial loan theory,simply discusses the concept of the two and discusses the relationship between the two,and lays the theoretical foundation for the following.The third chapter focuses on the development of rural financial lending industry and the evolution of its legal regulation.This chapter takes the time as the axis,anddiscusses the development of China's rural financial loan industry in the last three years from the beginning of the reform and opening up to the late 1990 s and the new millennium.In this paper,The Asymmetric Information Problem in the Development of Financial Loan Industry.At the end of this chapter,the author expounds the existing problems in the legal regulation of rural credit information asymmetry.The fourth chapter will focus on foreign practice,combined with the second chapter of China's rural financial information asymmetry legal regulation of the existing problems,targeted to introduce the typical state of the legislative practice.And the comparative analysis of these legislative practices,the initial extraction of experience.Chapter 5 is the key chapter of this article.This chapter puts forward some legislative suggestions on the information asymmetry faced by China's current rural financial lending.First of all,starting from the legislative concept,it is proposed to establish the principle of incentive legal regulation.And then the civil and commercial law and economic law as a perspective to carry out specific measures analysis.
