The Research On The United States' Natural Resource Damage Laws And Ecological Compensation System

Since the Industrial Revolution, demands for natural resources is growing. At the same time, with the development of science and technology, the means of access to natural resources and scale of resources needs are also growing and strengthening. On the one hand, human society in aspects such as economy, politics, culture has achieved unprecedented development. However, the ecological destruction and environmental pollution caused by the environmental incident also continues to increase.In China,with the rapid economic growth,industrialization and urbanization process accelerates,the ecological damage, the major environmental pollution and caused by the polluters does not get compensation, nor are the public's environmental rights and interests protected and ecosystem protection applied. in 2016, "the ecological environment compensation system reform pilot scheme" is put forward, it is to construct a complete ecological compensation system in next few years in the field of environmental law. In an aim of this, this article tries to research America's natural resources damage law and ecological compensation system for building our natural resources damage law and ecological compensation system.This article reviews the history of the US's natural resources damage law and ecological compensation system, especially in the early stage, the difficulties of the predicament from the perspective of jurisprudence and case in common law and written law. The second Part is mainly to review US's natural resources damage law and existing ecological compensation system structure,mainly in the federal laws system,including the "Superfund Act",the "Oil Pollution Act",the "Clean Water Act" these three federal laws to illustrate Constitutive elements of natural resources damage law and an ecological compensation system. The third part focuses on the more complicated and most valuable process, the evaluation process in the natural resources damage law and ecological compensation system. The last part mainly elaborates on summarizing and analyzing the experience and regulations in US's natural resources damage laws, and ecological compensation system. Finally, this article analyzes existing laws and regulations of natural resources damage laws and tries to build ecological compensation system and improve China's natural resources damage laws.In this article, the writer tries to use induction, the method of regulation research and case analysis,qualitative analysis and other methodologies, to review and analyze US's natural resources damage laws and ecological compensation system. as the enforcement of "pilot program", to establish ecological compensation system in China for the future, writer tries to offer some suggestions on the this filed. The main creation of this article is to analyze numbers of first-hand documents and tries to propose some constructional suggestion in the angle of technical legislation.
