Research On The Legal Issues Of Copyright Ownership Of Special Dance Works

Since the founding of new China, the creation of dance works, stage performances and related theoretical research, etc., have contributed to the accumulation of deep, rich and effective valuable experience,which in turn laid a solid and strong foundation for the further development of China's dance art. However, the legal consciousness of the Chinese dancers has been weak in the protection of intellectual property rights, the characteristics of the comprehensive and perishable nature of the dance art.The laws and regulations stipulate the ambiguity defined by the relevant concepts of the dance works,and the legal rights and interests of the copyright works. There have been successive series of dance works infringing copyright and ownership dispute cases. Based on this,through the study of "special dance works" copyright and the legal issues research, the author casts a view to the Chinese dance works copyright ownership of the relevant theoretical research, in the hope of playing a certain complement role as building blocks,and engaging dance art related workers, to help them with a more comprehensive,systematic, and in-depth understanding of the ownership of the copyright of the dance works, and the living environment of the Chinese dance arts. The research of this topic is divided into three chapters.The first chapter and the second chapter focus on the content of the identification of originality of the dance works and the content of the copyright of the dance works.Originality is the premise of the establishment of the copyright of dance works. With the provisions of "Copyright Law" and "Regulations on the Implementation of Copyright Law", the definition of "dance works", combined with the study of Chinese dance art theory, from the positive induction of dance works and the originality of dance works, the author reverse the exclusion of both positive and negative aspects of the dance works and carries out an in-depth exploration, summarization and qualitative study of the topic. This paper analyzes the contents of the copyright of the dance works and summarizes the problems of the copyright of the dance works, the property copyright, the neighboring right and the copyright of the Chinese dance works.The third chapter focuses on the related issues of copyright attribution of special dance works. The author analyzes the creative form and the particularity of the four kinds of dance works, cooperative dance works, commissioned dance works and folk songs.Then, combined with the relevant laws and regulations of "copyright" in our country, the author tries to give a tentative judgment on the copyright of the special dance works, and to prove the rationality of the judgment by the actual case analysis.
