Research On Commercial Mediation Of Modern Hunan Merchants (1900-1937)

To establish and perfect the diversified dispute resolution mechanism is the important content of building a harmonious and stable society,commercial conciliation as an important part of diversified dispute settlement mechanism,although play a positive role,but there are still shortcomings.In history,due to the economic structure change in modern China including hunan,the development of modern industry and commerce,commercial dispute also increases,the existing dispute processing mechanism has been unable to effectively solve the trading disputes,stable social order,in the late qing government to consolidate its rule,began a commercial legislation activities.In 1904 the qing government promulgated‘Concise constitution of chamber of Commerce’,stipulated that the chamber of commerce has the ability of mediation of commercial disputes,awaiting that with the establishment of the local chamber of commerce to ease the rulers’ appellate pressure,maintain social stability.The period of the republic of China,in order to further standardize the processing of commercial disputes,the government announced "the commercial arbitration in the articles of association",re-emphasized the commercial conciliation of the chamber of commerce functions.Due to the implementation of national policies and the development of the folk force,commercial conciliation become the main solution of modern hunan commercial disputes because of its unique advantages.But with the outbreak of the Anti-Japanese War,commercial activities in hunan region suffered enormous influence,commercial mediation also gradually weaken.But it is undeniable that modern commercial conciliation played an important role in commercial dispute resolution in hunan.The author hope to provide some useful reference for the perfection of today’s commercial mediation mechanism and the construction of diversified dispute settlement mechanism according to the investigation to the modern hunan business commercial mediation and achieve the purpose of drawing lessons from the past.Content of this paper consists of introduction,the text with three chapters,a total of four parts,including the introduction part mainly expounds the reason of my choice and the research significance,and simply introduces the relevant academic research results.The body of the first chapter for the modern hunan business concept and development process of commercial conciliation,this section defined the concept ofmodern hunan business commercial conciliation from two aspects of modern hunan business and commercial mediation,and simple combing the development of modern hunan business commercial mediation.Second chapter for the modern hunan business commercial mediation mechanism,separately from the main body of commercial conciliation,the object of commercial conciliation,mediation on the basis of commercial and commercial mediation to run the main steps of four aspects to explore the modern hunan business commercial mediation mechanism,and combining the relevant case analysis to summarize the characteristics of the present period of the commercial mediation.The third chapter for the modern hunan commercial mediation effect and influence,from the analysis sort from the modern commercial dispute case,commercial mediation as a kind of important way of social governance,has made remarkable achievements at the same time,also had a profound effect on later generations...
