Migrant Workers Industrial Indury And Compensation

In recent years,a large number of migrant workers enter into cities.Because of their knowledge and skills are limited,they often work on the grass-roots level or dangerous jobs.Construction of grass-roots workers require relatively low levels of knowledge and skills,to make a large number of migrant workers enter into the industry.As the body of the construction of grassroots workers,migrant workers often assume the industrial injury risk of the industry.In the absence of the labor contract and industrial injury insurance,construction migrant workers are a kind of temporary workers.They face complicated industrial injury compensation when industrial injury accident once take place.In fact,because of various conditions,many construction migrant workers face claim difficulties.Construction migrant workers ask for the compensation of industrial injury;In the process of the claim,the difficulties they encounter;the approach they choose to obtain compensation;and the influence of related factors and so on,those situations are subject to further study.This paper is based on the survey of 21 construction injured migrant workers in Chongqing,through in-depth interviews with them to understand their conditions of industrial injury,treatment and compensation,etc.And there are found:the first,in construction industry owing to the negligence of safety management,the lack of safety measures,insufficient safety awareness and experience of the construction workers themselves make the industrial injury accident of construction migrant workers take place frequency.The second,construction migrant workers lack the formal labor contract with construction unit and there is no corresponding industrial injury insurance,make the migrant workers encounter the problems such as treating difficulty and the compensation lack of standards in the process of industrial injury compensation.The third,different degrees of injury and the situation of human relations,access to effective help,work-related injury insurance and so on.All those make the industrial injury compensation has different characteristics.The fourth,construction of migrant workers' severity of the injury,the approach that construction migrant workers choose to obtain compensation,the information and help they get in the process of compensation,their personality characteristics,the understanding of the compensation problem,the position in negotiating,the scale of architects and the fluids of construction unit and so on all affect the construction of migrant workers to obtain the final compensation.Therefore,the policies suggestion of this paper lie in:First,state and enterprises should increase the strength on legislation and supervision of construction safety management.Second,aimed at the specific security problems of the safety consciousness and avoiding dangerous experience of construction migrant workers in construction site,the corresponding education and training should be carried out.Third,aimed at the industrial injury compensation of construction migrant workers,the country should come on the relevant laws and regulations to clear-cut the labor relations between construction unit and migrant workers,and carry out the situation that architects for migrant workers to purchase insurance.Fourth,furthering standardize settle negotiate compensation standard,solving the long-term guarantee problem of disability migrant workers,and managing the "strange phenomenon" in death compensation,in order to ensure construction injured migrant workers legal and reasonable compensation.
