In China traditional marriage culture,betrothal gifts have been playing an important role,today,the custom of bride price still has shown very strong vitality and with the development of social economy,the interpersonal relationship is increasingly close,gradually active ideas and dying,as a kind of popular in the folk tradition customs,and different ways to affect people’s lives.But because the relationship and economic life has become more complicated,and the disputes on betrothal gifts produced by more and more,especially typical in some economically underdeveloped rural areas,even the return of bride price cannot reach an agreement which leads to vicious criminal cases happened.The Supreme People’s Court issued"on the application of the" People’s Republic of China marriage law "interpretation of several issues(two)" set the rules of the return of betrothal gifts,there are clear provisions in the law on the bride price problem,judge refer to rules of the dowry dispute processing.But the judicial interpretation is still not clear the nature of betrothal gifts,at the same time for the academic circles in the nature of betrothal gifts are controversial,and the return of betrothal gifts in the judicial application also exists many problems,which also resulted in the operation of the discount.Through the study of the nature of betrothal gifts,in order to return the betrothal gifts to respect and give full consideration to the local customs as the starting point,to perfect the rules of the return of betrothal gifts put forward their own proposals.
