Study On Limited Compensation System Of The Consumer Protection Laws

The consumer protection law was the inevitable product of the society,implementing punitive damages to operators who violated consumer rights and interests,which suggested the national determination to protect consumers and standardize market order.Our country determined the amount of the maximum and minimum limits through multiple setting and fixed amount setting,clearing operators' responsibility of the maximum and minimum,that was the limit of compensation in actual.In recent years,the country has been strengthening the protection and the crackdown.On the one hand,this approach produced positive significance,which is noncommittally.But on the other hand,it could make the person worry some,that on multiple compensation settings,it may contribute to the rights events of asymmetric,and combining with the diversification of consumption types,the complication of trading behaviors,the early compensation approaches and experiences have been unable to adapt to this change,which would intensify social injustice again.So,how to perfect the compensation of damage system,has became the key problems that consumer protection laws would play a long-term mechanism.This paper abandoned the research of regular path of characteristics from the punishment compensation system,studying the limit compensation system with a different approach from the perspective of the amount setting.By comparing,giving examples,and combining with the theory and practice,this paper deeply analyzed the category of consumer protection laws,and the specific object of the limit the compensation system,explained in detail the specific connotation of limit compensation of consumer protection law.At the same time,mainly studied the computational base of compensation,and for the problem or the negative impact,combining with the hot issue of consumer protection,using the method of hypotheses,data modeling and so on,putted forward the perfect measures.
