A Probe Into Integrated Legislation Of Equity-based Crowdfunding In China

As a kind of crowd-funding,Equity-based Crowd-funding is the advanced stage of Inter finance.With the high speed of the development of the Equity-based Crowd-funding in China,the government not only gives strong backing to it but also strengthening normalized management to it.But there is still some lack of standardization that we don not have any specialized rule or law to follow.We still have some problem to solve in Equity-based Crowd-funding.Although there are more and more scholars have done some studies on Equity-based Crowd-funding,most of their studies are from content to perfect the equity and the raise of the Angle of legal regulation,but not the study of equity the raise integrated legislative problem.This article used the literature analysis method,inductive method and comparative research to study the dispute in the Equity-based Crowd-funding and summed up the lack of Equity-based Crowd-funding currently.Through the integration of existing study about all the raise equity and legislation,and on the basis of predecessors' studies of equity more in-depth analysis the legislation to raise the feasibility of integration.At the same time,based on the existing legal norms from the scattered legislation to unified legislation comparison and the effect of equity at home and abroad and the raise of different legislation,raise integration put forward China's stake in the legislative Suggestions and contents of the complete idea.This article has been divided into four parts:The first pair part: analyze the legal relation of Equity-based Crowd-funding and the present situation of it through the first Equity-based Crowd-funding dispute in China.The second pair part: Through raise the stakes in the existing legal regulation in our country,summarized the deficiency of the existing legal regulation,analysis the Equity-based Crowd-funding's necessity of integrated legislation in our country.The third pair part: Through the analysis of China's stake in the legal regulation theories,experience,policy support,timing,and raise the stakes in the present legislation around the world,to analyze the feasibility of the legislation.The last pair part: Put forward the reasonable idea of legislation in Equity-based Crowd-funding.
