An Empirical Analysis Of The Effectiveness Of People’s Jurors’ Participation

The people’s jury system is an important content of the judicial system with Chinese characteristics and an important carrier of the judicial democracy.The people’s jury system has played an important role and role in promoting grassroots judicial democracy construction,smoothing the people’s judicial participation,maintaining judicial justice and promoting the construction of the rule of law.However,with the deepening of the judicial practice of the people’s jury system,the problem of non-normalized operation is gradually exposed,and there are a series of problems such as "no trial".Based on the problems existing in the operation of the people’s jury system and the development of the reform opportunities,this paper puts forward the evaluation system of the evaluation of the efficiency of the people’s jurors,and designs the relevant measurement indicators.Baseing on the actual research data,this paper to objectively examine the people’s jurors in overall performance review process,namely,the quality and effect of trial.Also,explored the present situation of the people’s jurors and careful management,and the deep influence of people’s jurors audit quality,and the effect of the law,culture and other factors,especially the basic impact of the management of the trial on the basis of the quality of the trial,and then on the basis of the people from the jury trial management point of view,put forward to improve the people’s jury system and to enhance the quality of the basic countermeasures.This paper mainly uses the methods of literature analysis,social survey and empirical analysis in the research process.The whole thesis mainly includes two parts: introduction and text.The main body is divided into four chapters.The introduction part clearly points out the research background and research content of this paper.Based on the actual background and research status of the people ’s jury system,the concept of the effectiveness of thepeople’ s jurors’ trial and its research hypothesis are put forward and the evaluation index system is designed.The first chapter describes the status quo of the quality of the people’s jurors.According to the evaluation index of the performance of the people’s jurors,the status quo of the quality of the trial of the people’s jurors is described from the three aspects of the quality of the trial,the effect of the trial and the examination and management.The main problems are expressed in many aspects,for example,the collegial independence is insufficient,the interference is bigger,than ratio imbalance,court appearance evaluation degree is not high,selection is not in place,lax management,security,training,examination become a mere formality.The second chapter analyzes the influencing factors of the effectiveness of the people’s jurors,which is divided into four aspects: the legal system,the culture of reference,the group of responsibility and the management of the participants.Laws and regulations on the existence of legal differences and content defects,resulting in the qualifications of jurors;responsibility groups,the jury’s personal alienation and administrative authority of the confusion,resulting in the jury system of non-standardized operation;participation in the culture of traditional politics The impact of culture and the limitations of contemporary political governance philosophy,so that the operation of the people’s jury system lacks good social and political soil;through the correlation and casual analysis between the quality 、 effect and the management,confirmed the fundmental impact of careful management.In the third chapter,the basic suggestions on improving the quality of the people’s jurors are put forward.On the one hand,the internal remedies of the people’s jurors are selected as the main line,from the norms of the people’s jurors to improve the people’s jury trial mechanism,strengthen the people’s jurors management On the other hand,taking into account the external social environment of the people’s jury system,through the construction of national rule of law and the promotion of civic awareness,cultivate the social jury culture.Thus in the internal and external combination,to achieve the standard operation of the people jury system,and then to achieve the people’s jurors to improve the quality of trial.
