With the rise of the crime victimology in the field of international law,the role of the victim in the criminology is rediscovered,and the era of the crime is defined as the solo dance of the perpetrator are gone;in some of the crimes,there is a close interaction between the perpetrator and the victim,and the actual result of the crime is caused by the joint action of the two.The problem of the victim's risk of self-trapping in fraud was originally summed up from the precedents of negligent crime,which was later extended from the negligent crime to the intentional crime.At present,in the various types of intentional crime,due to the rapid development of society,economic crime emerging in an endless stream,the crime of fraud has become more and more widespread,it's shadow can be seen in general social life,financial markets,economic investment and other fields;all kinds of frauds are varied and fraudulent means are constantly renovated.As a kind of crime where the victim and the perpetrator are more interactive,the crime of fraud is easier to be associated with the interpersonal relationship in the risk society,so we examine the risk of self-trapping in fraud is also a necessary requirement of theory and practice.The research focus of this paper is based on the perspective of fraud,based on the analysis of the doctrines advocated by various scholars,this paper summarizes a set of more reasonable theoretical basis from the conclusion of the basic theory of the victim's self-trapping risk,explaining the judgment of the perpetrator's responsibility in the crime of fraud when victim is at the risk of self-trapping in fraud.Through the dynamic influence of the behavior of the victim in the crime,using the theoretical basis summarized above to determine how to make the responsibility and punishment more appropriate in perpetrator's responsibility penalty when victim is at the risk of self-trapping in fraud.
