Thesis On The System Of Lifelong Responsibility For Misjudged Cases

Judges' responsibility for life tenure is responsible for the quality of the case,and the judge's case responsibility has long been,but it has been controversial in theory and practice.The focus of the controversy lies in: the first,whether the more severe accountability method has the corresponding theoretical support;the second,whether the practice can play a role in preventing misjudged cases;the third,whether the practice can be implemented in practice.The purpose of this paper is to analyze the malpractice of the system of life tenure in judges,and to deny it,and propose new measures to prevent misjudged cases and improve the exemption of liability of judges.First,from the premise of the premise of accountability,the existence and identification of misjudged cases,the conclusion of the difficult misjudged cases and different standards;Second,in the theory of law,even in the legal principle,there are many deviations in such a way.In addition,this paper will argue that the judges' responsibility of wrong cases for life is not feasible,because it has great drawbacks in both the way of procedure and the effect.More importantly,the severe way of accountability reverse brings many negative effects.Finally,this article concludes that should deny the judges' responsibility for wrong case for life.At the same time,according to the causes of the wrong cases,the new measures that let the judges play an important role in prevention of misjudged cases will be taken to prevent and control the wrong cases.In terms of the judge responsibility system,this paper supports that should establish and perfect our country's system of the responsibility immunities toward judges,give the profession of judge the better security.Every step of judicial reform is important,hope that the discussion can contribute little to the reform of the accountability system of judges.
