Legal Analysis On The Clauses Of Trans-border Data Flow

“Trans-pacific Partnership Agreement”(hereinafter TPP).Though the new elected President of the United States,Donald Trump,had declared withdrawing from TPP,as a regional agreement which had been strongly supported by the United States,the rules of TPP offers us a clear reflection of the attitudes upon related key issues of the 12 parties involved.Under the issue of electronic commerce,the free flow of trans-border data is one of the most concerned.The rules of trans-border data flow of TPP results from the latest theory and practice of international community concerning data free flow.TPP tries to raise some specific standards for trans-border data flow but not just taking it as a supplementary provision of domestic privacy protection law.But the improvement is still limited due to the large conflict of interest of each TPP member.And our domestic regulations of trans-border data flow are non-systematic.They can be found in all kinds of normalizative documents of law,most of which are principles or general proposals and are not practical.It is essential to enact more systematic and specific regulations of trans-border data flow.This passage will have a case study on the related provisions of TPP transborder data flow,trying to analyze the legal rules of it,conduct a comparative analysis of the latest legislation in China,and offer suggestions on the improvement of regulations of trans-border data flow in China.
