Research On The Legal System Of Consumer Protection In China's Network Transaction

With the development of information technology,network has been an inseparable part of our lives and human beings have entered the information network era.We can watch videos,listen to music,go shopping and do many other things on the Internet.The advent of the information network era brings more opportunities to the society,and the constant appearance of new trading models and business models greatly influences people's inherent thinking and breaks the traditional trade framework,namely the electronic commerce.In the e-commerce environment,the trading behaviors between consumers and business operators have changed from the real life to the virtual network.The trading behavior occurring in the net world is like a double-edged sword,which brings convenience to consumers but also poses a great challenge.The degree of protecting consumers' rights and interests is one of the important symbols of a country that determining whether the rule of its law and its market are perfect and sound.This degree is also one of the important factors that restrict the development of electronic commerce.Without consumers' recognition and support,the electronic commerce will be vague and difficult.Therefore,protecting consumers' rights and interests in the virtual net world is of great significance to the development of electronic commerce in our country.The paper mainly explores the legal systems of consumers' rights and interests protection research in our country from four parts.The first part introduces the concept of network transactions and related problems in China.The second part analyzes a few typical problems that harm consumers' rights and interests during network transactions.This part develops from six aspects,discussing the consumers' right of privacy,right to know,to choose,right of fairly trading and returning of goods without reasons in network transactions respectively.The third part in this paper analyzes the content and main features of e-commerce legislation at home and abroad and outlooks electronic commerce legislation in our country combined with domestic and foreign related legislation at the same time.The fourth part puts forward the corresponding solutions aiming at the problems in the network trade,and some suggestions on solving the disputes in the network transaction and protection of consumers' rights and interests in the future electronic commerce.The protection of consumers' rights and interests in network transactions can not be achieved overnight.It is a systematic engineer,and it needs a combination of measures of consumers,business operators,the network trading platforms and the government.Therefore,the protection of consumers' rights and interests in China's Internet trading is around the corner and has a long way to go.
