Labor Law and Law on Employment Contracts are formulated in order to protect the legitimate rights and interests of laborers and establish harmonious and stable labor relationships.The inclined protection on rights and interests of laborers plays a significant role in balancing the labor relation of subjects.Yet,there are still some defects in labor law and regulation to define labor relation subjects.With the economic progress,the internal laborers are divided into different levels with discrepant strengths.However,due to the particularity and management identity,enterprise managers are more powerful than ordinary workers.But actually,the labor law and regulation in China doesn't value their particularity and dominance,and instead,they are treated as ordinary workers applicable for the same labor law.As a result,many unfair phenomena appear.This paper intends to explore how to apply in labor law and regulation by enterprise manager,a special group.Based on the particularity of managers,the problems existed in managers' applying in labor law are analyzed,and the rationality for their differentiated applicability in labor law is verified from the perspective of theoretical basis of labor law,extraterritorial legal institution and practical demand.Finally,the paper puts forward suggestions on enterprise managers' application in labor law. |
