The Philosophical Foundation Of Xi Jinping's Thought Of Rule By Law

Since the 18 th National Congress of the Communist Party of China,Xi Jinping,the secretary general of Communist Party of China,put forward the important thought of promoting the construction of the rule of law.His theory has far-reaching arguments and rich content,it contains a wealth of philosophical point of view,which is the foundation and guidance of constructing Chinese legal system.This article mainly analyzes the materialism thought,dialectics thought,epistemology and historical materialism though of Xi Jinping's thought of the rule of law.The Four Comprehensives is the theoretical guidance of socialist construction.That comprehensively implement the rule of law is the important part of Four Comprehensives,and the guarantee of other three parts,the key step to consummate our socialist legal system.Xi Jinping,who build his thought on Marx's philosophical materialism,discusses that the rule of law should proceed from the reality and should be based on the outstanding achievements of our predecessors;Secondly,he put forward the construction of rule of law should establish the view of development,wo should regard the mutual relation and interaction between social factors,and we should use the law of development to analysis the rule of law development;His idea of rule of law is also based on Marx's epistemology,he emphasize the rule of law should guide social construction,at the same time,it should get improvement in the social practice;He embarks from the historical materialism,propose that the Chinese law construction must be based on the social objective existence,must fully respect the dominant position of the people,and actively to exert the strength of people to promote the social construction.Xi Jinping's thought of law has far-reaching arguments and rich content,which contains a wealth of Marx's world view and philosophy,we explore the philosophical basis his law thought will be of great significance to enrich the contemporary connotation of Marx's philosophy and promote the construction of socialist law.
