Research On The Trust Law System Of Usufructuary Of Management Of Rural Land

In recent years,the transfer of usufructuary of management of rural land has been a hot topic.Normalize problem of the system of urban and rural economy.Rural economic base,faulty infrastructure and imperfect social security system,under such circumstance,a large number of migrant workers pour into the city to improve the living standards,resulting in overload of the city capacity,consequent shortage of rural labor force and land pastureland.All these restrict the rural economic development and upgrading of industrial structure,therefore,in order to improve the agricultural development of our country,we must set foot on the modernization and industrialization road and change agricultural management way.Trust as a way of usufructuary of management of rural land circulation,has its unique value.It has high conversion efficiency and can safeguard farmers' right to the contracted management of land and it also has the advantages of wide object.Shaoxing of Zhejiang province and Yiyang of Hunan province,have explored this method of circulation.They have obtained certain achievements,but also suffered from some problems.This article mainly explains the issues existing during the operation process and put forward the corresponding solutions on the basis of the acquired experience.This paper firstly introduces the basic concept of right to the usufructuary of management of rural land trust legal system,and discusses the feasibility and the necessity of this system.The second chapter analyzes the land trust outside of China and draws the experience for reference.The third chapter introduces the status quo of the right to the contracted management of rural land trust in our country.The fourth chapter points out the existing problems in terms of legal norms and supporting measures.Finally,on the issues explained above,the author tries to put forward certain suggestions in terms of clearing the body of the right to the contracted management of rural land trust legal relationship and its rights and obligations,improving the system of right to the contracted management of rural land trust tax system,and establishing a new rural land contracted management risk prevention measures and improving the system of right to the contracted management of rural land trust protection measures on the basis of the experience learned abroad.
