The Reapplication And Development Of The Conversion Rules On The Marital Property

An important system of matrimonial personal property in our marriage law is the conversion rules on the matrimonial personal property,the development of which is very complex:The ten years of "the deposit" hasn't made the conversion rules be forgotten,which drives the fierce discussion and research in the academic circle.China is a traditional country that pays attention to ethics,although with the rapid development of the social economy and the continuous change of the mode of transaction,the life,consumption and value of people will be changed greatly because of it.After the study of legislation and practical experience at home and abroad,I analyze the various views that support the abolition of the conversion rules and then do the game playing,and I can fully illustrate the rationality and feasibility of the conversion rules applied in our country.But if we reuse the conversion rules,it may be involved with a lot of social and legal relationship.It proves the rationality of the existence and the superiority of the system due to the previous research and practice of the test on the conversion rules.Therefore,the paper focuses on the perspective of the design of the rules to improve and do the institutional innovation on the system of the conversion rules,in order to use a new model-the conversion model with each passing year to solve the problems that the attribution right of the matrimonial personal property can't be confirmed in the duration when the marriage is still lasting.Therefore,through the research and writing of this paper,I hope to attract better views concerned with the study of the matrimonial personal property system,so as to promote the deeper thinking and research of the rules,and add something powerful to its "comeback".
