The judicial accountability system,which has attracted much attention,is the core and the key of the current judicial reform.As an important part of the judicial accountability system,the judges’ accountability system is the embodiment of the unity of power and responsibility as well as the protection of judges’ independent exercise of judicial power.In order to enable judges to better fulfill their duties of defending social justice,and to be able to exercise their jurisdiction independently,the existing system of accountability of judges must be improved.Although there are a large number of laws and regulations or documents on the issue of the judges’ accountability system at present,the accountability system has not been a good effect in practice.The reasons are the lack of the independent institution of accountability,the administrative tendency of the investigating process,and the complex scope of responsibility which is dispersive.Through the analysis of the judges’ accountability system in four different countries,we can draw some successful experience.To follow the rules and requirements of the judicial reform,I propose to amend the “Law of Judges”,establish a specialized and independent institution,develop some scientific procedures,define the reasonable scope of the accountability system and shorten the limitation of prosecution. |
