Study On Trademark Reverse Confusion Infringement

Recently,the phenomenon of trademark reverse confusion infringement in China appears frequently.we have to regulate the infringement of trademark infringement.However,the trademark reverse confusion and trademark tradition confusion are different in many ways,so their solutions are different.There is not legislation and judicial guidance.This article start from the new trademark law in China,and analyzes the phenomenon of trademark reverse confusion by the classic case of positive and negative ways,and then put forward more specific operational recommendations.This paper is divided into five parts.The first part analyzes the concept of trademark reverse confusion,the dangers and the main problems.The second part analyzes the determinants of trademark reverse confusion.The third part mainly analyzes the problems of civil remedy.And the fourth part puts forward some suggestions on how to perfect the counterfeiting system of trademark in our country.
