The research on the open of investigation has been studied for a long time,but it lacks effectiveness and integrity.Along with the arrival of development trend of Internet plus,the investigation work is facing new opportunities and challenges,the negative or improper disclosure will cause public opinion,which will make a great impact on the trial independence that after the procedure of investigation.In practice,there is a large number of cases that judicature has been affected by public opinion,the reason in most of them was that the case has caused strong concern and response in the initial investigation,hence,it is imperative to establish the system of the open of investigation in investigation phase.The mature system of the open of investigation must be established by relying on the open of investigation,media supervision and the interactive mechanism,we must make clear about the subject,objects,contents as well as methods of the open of investigation and media supervision.At the same time,channels of communication should be open up,to guarantee the effect of the open of investigation and the quality of media supervisionThe article consists introduction,text and conclusion,and the text contains five farts.The first part expounds the theoretical concept of the open of investigation and the media supervision,introduces the different understanding of the concept of the open of investigation,analyzes the subject,object,content and method of the open of investigation and media supervision in theory,and explores the modes of relationship interaction in theory.The second part selects ten cases which are widely concerned with the public opinion in recent years to be the research sample,in accordance with the media supervision intervention,moreover,compares and analyzes the elements of the open of investigation and media supervision,ensure the relationship and the development trend between them.The third part makes a detailed analysis on the basis of the open of investigation and the media supervision in the existing legal system in China,put the subject,object,content,ways as factors,combine the existing norms with the second parts of the in relevant analysis,which finds there are deficiencies in the existing legal system.The fourth part makes a comparative study on the status quo of the open of investigation and the rule of law outside the domain,focus on sorting out the relevant legal norms and practices,according to the reality of our country,the author analyzes and studies the advanced experience abroad.The fifth part combine the theory with Practice,a preliminary design and planning of the open of investigation system in our country is carried out,identify the relevant elements to determine the main body and the way of the open of investigation and media supervision as well as interactive communication mechanism between the two systems,to ensure the integrity and effectiveness of the system.
