Study On The State Guardianship System Of Juveniles In China

Juveniles are the future and the hope of one country.It is not only the obligation of the family,but also the responsibility of the society and the country to protect juveniles.In our country because of the influence of traditional culture,it is generally considered that the guardianship of juveniles is the internal affairs of the family,which leads to the fact that the interests of the juveniles are violated endlessly in practice.In the relevant laws,the state guardianship system of juveniles is stipulated,but it is strongly principled and has defective system and practicability,so the effect is not ideal in practice.This paper is divided into four parts to discuss the state guardianship system of juveniles in our country.The first part is about the nature and theoretical basis of the state guardianship of juveniles.First of all,introduces the origin and development of the state guardianship of juveniles,defines the concept of the state guardianship of juveniles and expounds the subject and object of the state guardianship of juveniles;secondly,discusses the nature of the state guardianship of juveniles;finally,analyzes the theoretical basis of the state guardianship of juveniles.The second part is about the status and problems of China's state guardianship system of juveniles.This part mainly discusses the legislation and implementation status,and the main problems of the state guardianship system of juveniles in our country,including the misunderstanding of the concept,the inadequate protection of the law,and the single form of realization.The third part is about the extraterritorial state guardianship system of juveniles and its enlightenment to our country.It is necessary to introduce the state guardianship system of juveniles of United States,Spain and Germany,we can get something useful from them.We'd better adhere to the principle of appropriate intervention,pay attention to the convergence with traditional guardianship,clarify the relationship the "state guardianship" and the "state supervision to guardianship ".The fourth part is to improve the state guardianship system of juveniles in our country.The perfection of the state guardianship system of juveniles not only need to break the old concept,but also need to improve the specific rules,also need government departments to work together.Through the government purchase and other ways to fully mobilize social forces,and actively absorb the social capital to make up for the lack of financial funds,so as to achieve the role of the state guardianship of juveniles.
