Delays in air law include flight delays and air transport delays.Air transport delays are not equivalent to flight delays,and there are differences in the applicable time periods between the two.International air law and domestic air law did not clearly define the concept of air transport delay.Judicial practice and academic research both put forward "agreed time","agreed time and reasonable period,said the combination of" and "classification criteria",and they are trying to clarify the concept of air transport delays.It is reasonable to define the concept of air transport delay on the basis of "classification standard".Delay in air transport is an objective fact,passenger transport delays should be judged from both the departure and arrival aspects,checked baggage delay should adhere to the "baggage with the people," the criteria used to judge the delay,the criteria of goods delay should be based on the agreement between the person and the carrier,and it is analyzed using the arrival delay.Air transport is a systematic project,resulting in delays for many reasons.Carrier people do not to bear the liabilities for delay when the reasons are as follows,weather,military activities and air traffic control and joint inspection,airports,passengers and public safety carriers can not control the causes of the delay is a reasonable delay,on the other hand,due to mechanical failure and the airline itself causes delays occurred,compared to unreasonable delay,the carrier should be liable for compensation.According to the different nature of air transport to determine the delay applicable to the law of compensation.The international countries and regions on the provisions of the air transport delays have some reference,China should first improve the legislation to develop practical basis for judging the basis of delay in air transport and carrier liability.Secondly,to strengthen airspace management system reform,optimizing the use of resources.Thirdly,the air carrier should provide consumers with a better customer experience,improve the delay after-work services,air transport associations should also strengthen the role of pre-and post-supervision.Finally,the air transport delay insurance should be improved,and make claims feasible and fast.
