The evolution of forms and stipulations of wars is an important crossover study between military science and philosophy.The Internet,which is born with a close connection with military,now induces high attention from many countries.It is subverting the traditional forms of battles and causing deep crisis at the statuary level.In viewing of that,it is great of academic value and sense of times to spotlight the evolution of laws and stipulations of cyberspace wars.The thesis is applying traditional research method like case study,comparative study,intelligence analysis,deductive and reasoning method and referring to the latest methodologies of other disciplines.It conducts an in-depth explanation on historical practice of legislation of cyberspace,dilemma of the existing laws,the latest attempt of “Tallinn Manual”.The research considers that the evolution of the laws and stipulations of cyberspace is the result of technology and the existing flawed laws directly shake the foundation of international legislation,challenge the principle of laws of wars and violate the basic spirit of UN Charter.It can be seen from the “Tallinn Manual” that the international conventions are now facing multiple constrains in systems,technology and stipulations.The future development of legislation of wars focuses on the mediation of the interests of countries and establishes a global management mechanism in cyberspace.The thesis draws its conclusion from the perspective of history and logic,reviews the development of cyberspace' laws and makes a deep analysis on the dilemma of the existing international regulations and Tallinn Manual.It is hoped that the thesis will theoretically clarify the constraints of the establishment of cyberspace's regulations and be beneficial to promote the international convention on the construction of cyberspace regulations.
