Researches On Property Rights Protection Of Private Colleges In China

In recent years,with the rapid development of private colleges,it has gradually become important part of higher education in China and brought up large quantities of professionals for the society.And there must have clear positioning on property rights of private colleges in China as well as establishing the system of protection for some relative property rights,if it wants to keep continuous,healthy and steady development.Besides,the development of China's private higher education started at a relatively late stage compared to Public higher education,which has a poorer foundation.Given the current situation of theoretical research,there lacks clear and unified qualitative and concept of property rights of private colleges in China as well as exists some misunderstandings.Other problems such as deletion of protection system and some correlative unsound laws and regulations,greatly hinder the continuous and healthy development of China's private colleges.Given in this area where lots of problems about the protection of property rights in China's private colleges are still left to solve,this article studies property rights of private colleges from various perspectives through reviewing literature and following practical generalizations.No matter on the system or the law,property rights of private colleges,as an emerging concept,lacks definite positioning and protection.The author conducts intensive study to find out the causes of those problems through analyzing the current existing problems on the property rights protection of private colleges in China.What's more the author also gives advice on the current property rights protection system of China's private colleges especially on law protection from drawing lessons from the practices and experiences of foreign private colleges on the protection system of property rights combined with the current development situation of China's colleges : Firstly,China's private colleges should establish the public welfare property rights system.Secondly,the government must give correct guidance on the development private colleges practically.Furthermore,Private colleges should define where its belongings of property rights is,and its beneficiaries' rights and obligations.It should also push forward legislative work of private education property rights,especially through improving and perfecting property rights ambulatory legal system of private colleges,establishing integrated property rights ambulatory system of private higher education and trading market,ensuring property rights of private colleges to be circulated and traded properly under the guidance of laws,keeping the development of private colleges thriving,as well as perfecting legal-person system of private colleges and internal governance structure in accordance with the law,strengthening assets supervision of private colleges and its responsibility,sticking to the principle of the property rights protection system of private colleges,in order to promote the healthy and continuous development of private colleges in China,to bring China's private education up at a higher level,to contribute a lot more for China's higher education.
