A Thesis On Amount Determination Of Mental Damage Compensation

In 1986,the general principles of civil law established the system of compensation for mental damage in china.After China’s legal theory and practice of decades of efforts,fully promote the development of the system,but because of China’s late start,lack of in-depth study and other reasons,the system is still not perfect,especially the spiritual damage has not yet formed a unified compensation standard model,the practical difficulties to the judicial practice.This paper focus on how to construct the standard model of the amount of compensation for mental damage,from the basic concept to clarify the mental damage as a breakthrough,three major difficulties analysis determine the amount of compensation for mental damage,the core value of spiritual damage compensation system as the starting point and goal,to explore the path for solving this breaking the plight of the three,the victim’s spiritual damage based on the level,construction standardization mode.
