Study On Some Issuess About Desistance Of Crime

Crime suspension as one of the suspended situation of the intentional crime which plays an important role in the commission of a crime.In theory,there is a big misunderstanding in using the constitutive requirements of the Crime suspension because the lack of consensus in postive and nagtive Crime suspension,and The judicial practice be seriously effected as the rules of crime suspension is not perfect enough.This paper will study on both postive and nagtive Crime suspension with basic theory on Criminal Law,and find out the deficiencies of stipulation in Crime suspension to give some inspiration to the judicial practice.The first chapter will study on the diffenences between postive and nagtive Crime suspension,including the concept and scope of Crime suspension.The second chapter will study on the automaticity of Crime suspension.I will mainly discuss the concept of automaticity of Crime suspension,and then I will analyse the standards of automaticity of Crime suspension.The third chapter its about the effectiveness of Crime suspension.Including the concept and the defects of Crime suspension in China,and then,I will give some advice to make up for it.The last chapter will study on discontinuance of joint crime and departing from joint crimes.fisrtly,I will discuss the differences between the simple and complicated of discontinuance of joint crime,secondly,I will mainly analyse the theory of departing from joint crimes,and make up for the defects of discontinuance of joint crime...
