Medical fault which is the core element of medical tort responsibility.Its seting up or not is challenged by medical and legal dual profession.As to the current regulations of "Tort Liability Law",the standard of medical fault is too fuzzy,the words are too subjective,both of which have led to the problems of trial and the appraisal.There're many differences and a lot of controversy,especially in the case of informed consent right existed between ethics and legal compliance.Both of healer and judge are nagged by the contradiction of them.Although restricted to the healthcare industry development,the complexity of medical behavior,the disease development constraints,the standard of medical fault could not have full coverage to the practice of every situation,but it's urgent and necessary to summarize and complete the conditions as that occurred,predicted or in doubt,and confirm the concrete and objective recognition.Based on practical judgement,I summarize the controversial questions,mainly discuss the "medical level" defined factors,authority and procedures of emergency disposal,"complications",error and allowed degree,practic problem such as applicable and prescriptions,aims to seek a more reasonable and more objective fault standards.
