On The New Theft Crime In China

In our country Larceny is the highest crime rate.And it is a crucial task of previous amendment facing by the China's Criminal Law to prevent and crackdown the crime.Before the Amendment of the Criminal Law,Larceny mainly adopted the standards of“amount” and “frequency”.After the revision,the Criminal Law added three actions of larceny,that is burglary,theft with weapons and pick pocketing.There are 4 Chapters to research the problem of the new larceny.Chapter 1 mainly discusses the problem of the burglary.In burglary,the concept is clarified at first.Then discusses the substance of the household.Meanwhile,I propose my own points of the elements of burglary and the criminal pattern.Chapter 2 mainly discusses the problem of the theft with weapons.In theft with weapons,I compared with the conception of the theft with weapon,the difference between the weapon and ordinary goods and tools of crime.Chapter 3 mainly discusses the problem of the pickpocketing.In pickpocketing,I analyze the conception,constitution,the public place.Chapter 4 is to analyze the shortcoming in the legislation.Then get this conclusion.It is not appropriate to make all the action be criminal.So we can limit the amount of such crimes set,and the circumstances of the crime as the conviction and sentencing of and based on an analysis.
