| At the Central Political and Legal Work Conference in 2017,General Secretary Xi Jinping stressed that we should continually innovate our ideas,systems and methods,meanwhile comprehensively enhance the level of preventing various risks,thus ensuring the long-term stability of the country and the peaceful life of the people.In the general circumstances of serious criminal offenses being controlled and overall social stability,the prominent factors affecting current social security situation are "small cases" with theft,snatch and fraud as the main types.However,in the fight against "small cases",it has long been exposed that large campaigns are distinctly superior to long-term mechanisms.In view of this,we must actively respond to the Ministry of Public Security who called on breaking more "small cases".To achieve it,working mechanism needs to be innovated,the ability of preventing risks should be enhanced,and the level of controlling "small cases" ought to be improved.All in all,It is necessary to innovate methods and integrate resources at the micro level,such as " unified organization,scene investigation,intelligence research,operating spy,removing lawsuits" mode of cracking,but the macro protection of the system,law and communication are also obligatorily needed.The first part is an overview of the "small cases" issue.It is analyzed mainly from the economic development,changes in the structure of the crime and other aspects about the cause of the problem,and then the academic definition of "small cases" is made.The second part is the necessity analysis of the working mechanism of breaking "small cases".The characteristics of it and the current investigation dilemma both forced the investigating organs to change mode.Moreover,the working mechanism of the "small cases" is also in line with the requirement of saving judicial resources and improving social security.The third part is to elaborate the shortcomings of the "small cases" work.At the macro level,it is characterized by the governance model differences and investigative power allocation behind it.And the micro level involves the misunderstanding of specific works.The fourth part is the focus of the article.It is the reconstruction of the working mechanism on breaking “small cases” combined with particular examples,which is mainly related to several aspects like subject investigation,scene investigation,intelligence judgment and so on.Hence a complete cracking chain of "small cases" is formed.The last part is about the protection of the working systems.Only the concrete protection in law,system and communication can effectively improve the ability of breaking "small cases". |
