Legislative Perfection Of Sexual Offenses Against Minors

For years,more and more cases of sexual offenses against minors were reported by the media,and these reports attached great importance to protect the sexual rights of minors.Although at the end of 2013,relevant department released the interpretation about punishing minors' sexual assault in accordance with the law,and the criminal law was modified about sexual offenses against minors by 2015,there are still many deficiencies to the protection of the minors' sexual rights on the criminal law.Based on the criminal legislation,the author analyzes the deficiencies,and put forward legislation.The first part is an introduction of the basic problems about sexual offenses against minors.First of all,the author tries to define the concept of sexual abuse.And then,according to this concept,the author can define the scope of sexual offenses against minors on the criminal law.Finally,through analyzing the statistic data of cases about sexual offenses,the author can summarize some characteristics of these cases and necessities for protecting minors' sexual rights.The second part is descriptions of legislative situation and defects.The description of legislative situation bases the criminal law.Then,according to this description,the author will find legislative defects,such as inappropriate accusation setup,scattered distribution of legal rules,unequal protection,incomplete subject of crime,and incomplete protection of victim.The third part is an introduction of foreign legislative situation.These foreign countries are Britain,America,Germany,and France.Their advanced legislation is worth learning,such as expanding modes of criminal behaviors,expanding subject and object of crime,setting up some independent charges to protect minors' sexual rights,and expanding legal rules about special subject of crime.The last part is legislative perfection.We will make suggestions about the defects what were mentioned in context,such as resetting accusation setup and sections,expanding criminal object,improving legal rules about special subject of crime,and improving the content of legal rules about criminal behaviors.
