Research On The Legal Issues Of The Third Party Debt Collection In China

Affected by the economic downturn,China's non-performing loans of financial institutions increases and the increasingly serious situation,financial institutions,pay attention to debt collection,its energy is limited,due to financial institutions in order to reduce the cost of collection,improve collection efficiency,financial institutions often choose to entrust a third party debt collection agencies for collection.In actual operation,because our debt-collection legislation almost "blank",national legal policy regulation does not reach the designated position,the third party debt collection agencies to nonstandard collection of debtors,even violate the criminal law of our country,constitute a crime.This not only violates the legitimate rights and interests of the debtor,to a certain extent,also affect the healthy development of financial market and the stability and prosperity,so will the third party debt-collection into legal track.This paper uses the methods of empirical analysis,comparative analysis of legal issues related to our country third party debt-collection,debt-collection outside third party supervision experience,analysis of reference for the current existing problems in the our country third party debt collection,to the improvement of the system of third party debt-collection argumentation and analysis.
