Study On The Legal Protection System Of Laborers’ Right Of Prosecution

In recent years,the problem of unfair treatments of laborers due to prosecution has increasingly aroused concerns of the society,and this directly challenges our nation’s legal protection system of laborers’ right of prosecution.The rights of prosecution belong to one of the supervisory rights that are granted to the laborers,and with the aid of the laborer sin their positions in an enterprise of an institution,they will facilitate them in bringing into force in the aspect of maintaining national and social public interests.With the constant progress of our nation’s law construction,there is an urgent need for the research of the protection system of the laborers’ rights of prosecution;however,in our nation’s current legal provisions,there are usually stipulations in principle regarding the laborers’ rights of prosecution,and regarding the protective and penalty measures on the prosecutions are mostly implemented indirectly based on other legal provisions and they feature poor operability,thus resulting in numerous difficulties in the executions of the laborers’ rights of prosecution and severely hampering the initiatives of prosecution by the laborers.This paper conducts research on the laborers’ rights of prosecution from the following aspects.First of all,through the in-depth analysis of the domestic and overseas definitions of the rights of prosecution,it further derives at the due connotations of the laborers’ rights of prosecution,their differences with the citizens’ rights of prosecution,as well as the practical significance of ensuring the laborers’ rights of prosecution and it aims to gain a macroscopic and thorough comprehension of the laborers’ rights of prosecution.Secondly,through the application of comparative analysis,it sorts the relevant provisions on laborers’ rights of prosecution in our nation’s current laws,and,by conducting research and analysis of the legal protections of the insider prosecutions in major foreign nations,it focuses on the major existing problems in our nation’s protection system of the laborers’ rights of prosecution and further proposes relevant thoughts of solutions with pertinence so as to enhance the further perfection of the legal protection of the laborers’ rights of prosecution and promote the development of the law construction with Chinese characters.Thirdly,in the analysis of the existing problems in the protection system of the laborers’ rights of prosecution,it adopts the perspectives of such three aspects as the protection mechanism,incentive mechanism and relief mechanism,and,in combination with the analyses of cases,itrespectively proposes the legislative suggestions and concrete conceptions on the existing problems and flaws in the protection stipulations of the laborers’ rights of prosecution in our nation’s laws with an attempt to perfect the legal protection system of the laborers’ rights of Prosecution.
