Medical Trouble Analysis Of Crime Of Assembling A Crowd To Disturb Social Order

"Medical trouble" reflects the doctor-patient relationship under the doctor-patient contradiction growing warm trend of alienation,The "Criminal Law"("Amendment Nine")article 31 incorporated the "medical order" into the protection of the crime of assembling a Crowd to disturb social order,but the academic and practical has not yet formed a consensus about "Medical trouble".The definition of the elements of the crime of disrupting the social order and the positioning of the elements in the judicial practice and the relationship between the six specific social order in this article all have a real impact on the establishment of the crime.In this paper,the study of the crime of disrupting social order mainly includes three parts:First of all,introduces the background and significance of "medical trouble",the problem of convergence between "medical trouble" and related regulations is discussed emphatically.Secondly,discusses the legal interests and behavioral types of the "medical trouble" and disturbs the social order crime,and studies the relationship between the medical order and other social order,and makes a detailed interpretation of the difficult problems in the elements of this crime.Next,in the form of case,the author points out the positive responsibility elements of the crime of disrupting the social order in the form of "medical trouble":the intention,the purpose and the motive,and the subject identification of the crime.Finally,the author analyzes the problem of the number of crimes in the judicial judgment,and studies the problem of the transformation of the crime.Through the above analysis and discussion,in order to provide theoretical guidance for the parties to control the"medical trouble",effectively alleviate the doctor-patient conflicts and confrontation,make a construction to boost the harmonious doctor-patient relationship.
