This paper focuses on the renewal of land use right after the expiration of commercial housing.In our country,because the establishment of the land use system of commercial housing is short,there are many places that are not in place in the specific regulations,especially if the legislation on the renewal of the land use right is too general and incomplete,and even many aspects are only a few,There is no specific legal provisions;and the existing laws and regulations also exist in conflict with each other.In recent years,with the local part of the real estate land use rights gradually expired,the issue for the community widely concerned,the academic community also conducted a corresponding study.Because of the shortcomings of our legislation will lead to the lack of the basis for solving the problem.Therefore,this paper focuses on this social hotspot,focusing on the analysis of the system from the set of issues.This paper is divided into three parts,the first part is mainly about the land use right of our country,and the status quo.The part of the first clear commercial housing and commercial housing land use rights and other concepts.From the concept of commercial housing,the characteristics to grasp the nature of commercial housing;combing the evolution of state-owned land of urban land,and summed up the current commercial housing with the term land use rights of the provisions of the law,and then outlined the current academic research on this issue and the main Controversial focus.The second part mainly analyzes the commonness and the difference,the superiority and the shortcoming of the German,Japanese and Taiwan modes,and finds the good experience and the lesson for the protection of the land use right of our country.The third part is in China's commercial housing and commercial housing land use rights have a fundamental and comprehensive understanding of China's commercial housing land use rights made by an operational concept,mainly from the payment of renewal and renewal of the two Aspects of the start.This paper discusses the rationality of the two approaches of universal differential payment renewal and one-time renewal of 70 years from multiple perspectives.
