The Study Of Entrapment Used In Administrative Enforcement Of Law

Because of the low cost and high efficiency,the entrapment,which is normally used in criminal investigation,is now increasingly used to take the evidence in the fields of administrative enforcement of law.As a special means of gathering evidence in some very complicated cases,the enforcers of administrative law will hide their identities,use the traps or supply fake information to confuse their real intentions and tempt administrative counterparts to expose their illegal evidence.Because of the excessive pursuit of “high performance-price ratio”,there are some problems emerging in the administrative enforcement of law,such as abusing traps,high rate of errors and even malignant illegalities.As a double-edged sword,we should be very cautious on the use of entrapment in administrative enforcement of law.We should neither deny the positive effects nor ignore the negative effects of entrapment.As an abnormal means of gathering evidence,entrapment should be strictly limited in the proper range.There should be standard operating procedures which includes examining and approval,account ability and legal remedy ect.We should make full use of the low cost and high efficiency of entrapment and minimize the harmness.
