The Defense Of Battered Woman Syndrome (BWS)

Domestic violence is a global social problem,and the victim is mostly female.Many women have long been subjected to domestic violence,but can not get rid of such a tragic situation,in the case of intolerable to kill the abusers to save themselves,but had to face the severe punishment of the law.In recent years,the battered women who kill their husband universally sentence to heavy punishment in China,and the similar cases of different sentencing occur obviously.So crime,responsibility,punishment to adapt,whlie fair and justice to achieve in these cases,require the effort of the theoretical realm and the practical circles.The foreign theory of "battered woman syndrome" plays an irreplaceable role in the cases that the battered woman killing her husband,and it become efficacious defense to deal such cases.On the basis of introducing the theory and extraterritorial judicial practice of battered women syndrome,the writer analyzes the arguments for the defense of battered women syndrome,and tries to design the rules for introducing the theory of battered women syndrome into Chinese judicial practice.While affirming the defense of battered women syndrome,we should not abandon our review of the defense to prevent using battered women syndrome to cover up the real murder.
