Necessity Censorship Custody After Arrest

The current Criminal Procedure Law has increased the content of the Necessity censorship custody after arrest,in order to change the status of criminal suspects and defendants in the criminal proceedings.This paper analyzes the basic value of the necessity of the custody of the criminal suspect before the implementation of the existing criminal procedure law,and then analyzes the basic value of the necessity of the detention after the arrest,and then compares the two legal systems.This paper summarizes the relevant provisions of the existing laws,regulations and judicial interpretations,and also summarizes the contents of the review system of necessity of detention after arrest.On the basis of the provisions of laws,regulations and judicial interpretation,this paper conducts the legal analysis and demonstration,discusses the relevant functional departments,the stages and the process of litigation.In view of some problems existing in the practice of this system,this paper analyzes the reasons,and finally puts forward the perfect suggestions.
