The Empirical Research On Sentencing Factors Of Larceny

Through reading the relevant literature,with the aid of SPSS statistical analysis method,this article use the regression analysis method to study and analyze,that is,the main use of multiple linear regression method and the binary Logistic regression method is to establish the regression model of the corresponding decision larceny,and to calculate the quantitative relation of the sentencing factors significantly and the corresponding punishment decision;In addition,according to the sentencing factors affecting relative importance from the established regression model,to determine imprisonment,fine,punishment,probation,and the probation period for judgment in the crime of theft,and using the forecast method to calculate the benchmark of corresponding penalty judgment.Through the statistical description of the 2258 larceny judgments in China,we know the sentencing situation in the whole country,the eastern region,the central region and western region.At the same time,through the regression model constructed by the analysis of the factors that affect the effect of theft imprisonment,fines amount,probation and probation period,and the relative importance of the relevant factors significantly affect the sorting decision.Finally,we conclude the fact that the base of theft of prison sentence and fine punishment decision are the amount of the theft,and then calculate the benchmark sentence in prison and fines;the probation standard of theft of sentence includes he three factor:theft amount,the previous record,and attitude of paying back money,and calculate the the standard of the probation;the corresponding fact about the standardization specification of the probation period of larceny is only the amount of the theft,and at the base of fact,to calculate the corresponding standardization specification.
