A Study On The Cause Of Death Investigation In Law Enforcement Activities

In today's world of death investigation mode is divided into two parts,namely,independent and affiliated.China's death investigation system is completely attached to the criminal procedure law,and to the investigation organ as the center of the model.The inquest pattern has many problems in practice,also led to many social conflicts.The death situation in China this paper in the process of law enforcement as the starting point,the use of comparative law research methods,focuses on the analysis of death investigation subject is set up,and the identification of institutional settings,and the analysis of basic process of death survey,inquest related avoidance procedures,sentencing hearing procedure,supervision procedure,try to suggest suitable China national death survey system,let the inquest into orbit.This paper is divided into four parts.The first part is on the type of analysis of China's law enforcement in the process of death.The main interpretation on China's way of processing the events of different types of death,and to clarify the unnatural deaths that occurred in the category of civil servants law enforcement in the process of unnatural death events.The second part is the analysis on the cause of death investigation subject set.This paper mainly introduced the current research subject and the existing problems in China,and the main body to investigate other system settings is introduced,such as the coroner's court,Forensic Bureau System,Forensic Science Institute of medical bureau,to learn from mature systems.Through the analysis,under the existing national conditions,the main body of death investigation should be borne by the pro-curatorial organ.The third part is the analysis on the setting mechanism.The current identification mechanism in China and the existing problems,and the identification of other institutions under the system set are introduced,such as the coroner's court,Forensic Bureau System,Forensic Science Institute of medical bureau.Referring to the relevant foreign system,our country can be led by the Ministry of justice,in the Institute of forensic medicine,a number of high level of Research Institute,given the qualification of the cause of death identification institutions.The fourth part is the construction of the basic system of China's death investigation system.Where there is no remedy,there is no right.This part mainly includes: the basic procedures of the investigation on the cause of death avoidance procedures,sentencing hearing procedure,supervision procedure,to guarantee the realization of civil rights.
