Against domestic violence on a global scale is becoming a hot spot law,all countries spare no effort to solve the influence of family harmony,social stability problems.Began in March 2016 the implementation of China's first "anti-family violence law",of special legislation to make up for the domestic abuse legislation against the deficiency of in our country,to promote the rule of law in China,safeguard the rights and interests of the parties provides a strong legal support.Domestic abuse method against the main object of protection for the family members,family relationship has its illicit close sex,the intervention of public power is bound to affect the harmony between the secrets of the family relationship and family members.Therefore,establish the public power of domestic violence intervention reasonable limit,is advantageous to the respect for and protection of private rights,prevent the abuse of public power,the maintenance of family harmony and stability,and play a role of morality.But the violence in the home practice,there are public power intervention in excess,and the problem of insufficient.This paper analyzes its existing problems and reasons,from the house of the principles of violence,clear the scope of the public power intervention and strength,in the main body responsibility,improve the judicial intervention program,the public power abuse and not as a relief way domestic abuse prevention and control of public power intervention in confirm reasonable limit.In ensuring the lawful rights and interests of the parties at the same time makes the public power can get a reasonable and effective use,in order to effectively curb domestic violence,maintenance of family harmony and social stability.
