Acquisition in good faith is provided in Art.106 in Property Law.According to the system,the "ex right disposition" is the prerequisite for the goodwill acquisition.First,this paper analyzes that "ex right disposition" in goodwill acquisition of real estate in China means that there is an errosr in registration and the Registrant who has no right to dispose disposes the real estate,and then four typical cases are briefly introduced(including registration error,borrowing name to register,limitation of right to dispose and incomplete registration on joint property)in order to clarify that the key definition on "ex right disposition" lies in the legal significance of real estate registration,Which is not clear in the current law of our country.Therefore,in understanding the meaning of registration,we should adhere to the mode of change of real estate real right in our country,so as to strictly distinguish between the "ex right disposition" and disposition. |
